Definition
Beneficial ownership matters in treaty and withholding analysis because a reduced rate usually depends on more than being the named payee. The recipient generally needs to be the real economic beneficiary under the governing rule rather than a conduit or nominee.
Examples
- A company receiving royalties on behalf of another party may fail a beneficial-ownership test.
- A lender claiming treaty benefits on interest usually needs to be the beneficial owner of the interest.
