Definition
A withholding agent is the operational actor in many cross-border tax systems. The recipient may care about the final rate, but the withholding agent is the party that has to collect the tax, manage the documentation, and bear the immediate compliance risk for getting that step wrong.
Examples
- A U.S. payer making FDAP payments can be the withholding agent for Chapter 3 withholding purposes.
- Source-country withholding disputes often begin with what the payer was allowed to rely on at the time of payment.
