Definition

The QEF election under Section 1295 requires current inclusion of pro rata share of PFIC ordinary earnings and net capital gain. It requires the PFIC to provide Annual PFIC Statement.

Examples

  • A U.S. individual investor in a foreign mutual fund makes a QEF election to avoid Section 1291 excess-distribution treatment.
