Definition

The federal estate tax under Section 2001 applies to the taxable estate above the basic exclusion ($13.61 million for 2024, scheduled to sunset to roughly half in 2026 absent legislation). Marital and charitable deductions reduce the taxable estate.

Examples

  • A decedent with a taxable estate of $20 million owes federal estate tax on the excess above the basic exclusion.
